Conflicto de Competencia suscitado entre la Sala Civil Familia del Tribunal Superior de Cúcuta y el Juzgado Tercero Administrativo Oral de Cúcuta, en torno al trámite de la acción de tutela de la referencia.
Luego de reiterar el marco jurídico que determina la competencia en materia de tutela y de analizar el caso en concreto, la Sala Plena resuelve el conflicto ordenando enviar el expediente a la Sala Civil Familia del Tribunal Superior de Cúcuta, para que de manera inmediata tramite y adopte la decisión de fondo de primera instancia a que haya lugar, respecto del amparo constitucional deprecado.

DEJAR SIN EFECTO el auto proferido por el Tribunal Superior de Cucuta, Sala Civil-Familia, el 3 de diciembre de 2013, dentro de la accion de tutela promovida por Olga Ascanio Sanchez y Argelino Becerra Vacca, actuando por intermedio de apoderado judicial, contra FINAGRO y el Banco Agrario de Colombia S.A.
- Segundo. REMITIR al Tribunal Superior de Cucuta, Sala Civil-Familia, el expediente que contiene la accion de tutela presentada por los accionantes (ICC-1980), para que de manera inmediata tramite y adopte la decision de fondo de primera instancia a que haya lugar.
- Tercero. Por la Secretaria General de la Corporacion, COMUNICAR al Juzgado
- Tercero. Administrativo Oral de Cucuta, la decision adoptada en la presente providencia.
